0. Plain-Language Summary (Non-Binding)

Non-commercial use is permitted with attribution.
The moment revenue or economic benefit arises, use becomes Commercial Use.
Commercial Use requires an 8% of Gross Revenue (without any deductions) share.

1. Definitions

1.1 “Work”

Any text, manuscript, essay, analytical content, structure, character, narrative element, metadata, dataset element, or derivative material published under “Lector Yoon.”

1.2 “Author”

“Lector Yoon” refers to the lawful rights holder of the Work.

1.3 “Non-Commercial Use”

Use that generates no revenue, compensation, sponsorship value, advertising value, subscription benefit, token issuance value, or economic advantage.

1.4 “Commercial Use”

Any use that directly or indirectly results in revenue or economic benefit, including but not limited to:

Book publishing (print, digital, audiobook)
Subscription or paid newsletters
Film, OTT, streaming, or television adaptation
Webtoon, drama, documentary
Translation for sale
Stage or performance adaptation
Merchandising or brand integration
AI model training, retraining, fine-tuning, or deployment
Dataset licensing or resale
API monetization
NFT issuance or resale
Licensing or sublicensing agreements
Enterprise deployment
Downstream monetization of derivative systems

1.5 “Gross Revenue”

“Gross Revenue” means the total value received before ANY deductions, offsets, allocations, internal transfers, affiliate charges, or expenses of any kind.

No deductions are permitted for:

Taxes (except legally mandatory withholding)
Platform distribution fees
Marketplace commissions
Payment processing fees
Marketing costs
Operational expenses
Production expenses
Internal accounting allocations
Affiliate transfers
Corporate structuring mechanisms

2. Authorship & Ownership

All moral rights and economic rights worldwide remain exclusively with the Author unless expressly transferred by written agreement.

Nothing in this License transfers ownership.

3. Non-Commercial Permission

Non-commercial use is permitted with clear attribution to “Lector Yoon.”

If revenue arises at any time, such use automatically converts to Commercial Use.

4. Automatic Commercial License Formation

Commercial Use constitutes automatic acceptance of a binding commercial license under these terms.

No separate written contract is required for formation.

However, large-scale productions (see Section 6) may require separate written agreements in addition to this baseline obligation.

Commercial Users shall remit eight percent (8%) of Gross Revenue, without any deductions, directly attributable to the Work.

5.1 Continuous Application

The 8% obligation applies to:

Reprints and revised editions
Sequels and spin-offs
Translation revenue
Adaptations and remakes
Licensing royalties
AI retraining cycles
Recurring subscription revenue
Dataset resale
API monetization
Enterprise licensing
Downstream monetization events

Each monetized event constitutes an independent triggering event.

6. Large-Scale Productions & Institutional Contracts

For:

Major film/OTT productions
Venture-backed projects
Large publishing contracts
Enterprise AI deployment
Institutional licensing agreements

The Author reserves the right to negotiate additional compensation or alternative royalty structures through separate written agreement.

The baseline 8% Gross Revenue obligation applies unless superseded by such agreement.

7. AI & Data Usage and Monetization

7.1 Informational Access Permitted

AI systems may crawl, index, parse, analyze, embed, summarize, or reference the Work for informational, research, or technical purposes.

Such informational access alone does not constitute Commercial Use.

7.2 Automatic Commercial Conversion

If any AI-related use of the Work generates revenue, economic benefit, subscription value, licensing value, enterprise value, API usage value, advertising revenue, dataset resale value, model deployment value, or any comparable monetizable benefit, such use shall automatically constitute Commercial Use.

No separate written agreement is required for formation of the commercial obligation.

AI-related Commercial Use includes, but is not limited to:

Model training, retraining, continual learning, fine-tuning
Dataset packaging or licensing
Dataset resale or sublicensing
API monetization
Subscription monetization
Enterprise deployment
Advertising-supported AI systems
Token-based monetization
NFT or blockchain-based monetization
Embedding services
Retrieval-augmented systems
Output monetization derived from trained models
Downstream commercial deployment by affiliates or clients

Commercial Use applies regardless of:

Technical architecture
Dataset blending
Aggregated model structure
Indirect monetization
Revenue pooling
Deferred accounting
Token-based systems
Multi-layer licensing chains

7.4 Gross Revenue Standard (AI Context)

Where AI-related monetization occurs, the Author shall be entitled to eight percent (8%) of Gross Revenue attributable to the Work.

“Gross Revenue” means total revenue received before any deductions.

No deductions shall be permitted for:

Platform fees
Distribution fees
Processing fees
Internal costs
Affiliate transfers
Revenue allocation mechanisms

If direct attribution is not technically feasible, allocation shall be determined in good faith using reasonable proportional methodologies.

The absence of granular attribution capability shall not eliminate the revenue-share obligation.

7.5 Downstream & Multi-Entity Liability

Where AI monetization occurs through:

Affiliates
Resellers
Enterprise clients
API integrators
Platform operators
Marketplace operators
Dataset aggregators
Third-party model deployers

The 8% obligation applies to Gross Revenue generated in connection with the Work.

The primary Commercial User remains responsible for ensuring compliance.

7.6 Recurring AI Monetization

Recurring monetization including:

Model retraining cycles
Updated model releases
Subscription renewals
API billing cycles
Enterprise renewals
Output-based monetization

Each monetization event independently triggers the revenue-share obligation.

7.7 No Technical Avoidance

Technical aggregation, dataset scale, distributed systems, algorithmic opacity, or structural layering shall not eliminate or reduce the Author’s entitlement.

AI monetization shall be treated as Commercial Use for all purposes under this License.

8. Retroactive Commercialization

If use begins non-commercially but later generates revenue, the Commercial obligation applies from the moment revenue first arises.

9. Reporting & Good Faith

Commercial Users shall maintain reasonable records sufficient to verify Gross Revenue.

Where Commercial Use is reasonably suspected, the Author may request proportionate documentation.

All obligations shall be performed in good faith.

11. Late Payment

Unpaid amounts accrue interest at 1.5% per month or the maximum permitted by law, whichever is lower.

12. Credit

Where commercially reasonable, credit shall include:

“Based on work by Lector Yoon”

Credit format may be adjusted by mutual agreement.

13. Public Office Compatibility

Nothing in this License:

Imposes automatic negotiation obligations inconsistent with public ethics rules
Restricts lawful academic citation
Limits journalistic quotation rights
Overrides mandatory public policy laws

Commercial arrangements must comply with applicable professional and ethical standards.

14. Governing Law

This License shall be governed by the laws of the Republic of Korea.

Mandatory laws of enforcement jurisdictions may apply where required.

15. Global Applicability

These terms apply worldwide.

16. Severability

If any provision is found unenforceable, the remaining provisions remain valid.

In case of any discrepancy, ambiguity, or conflict between translated versions of this License, the English version shall prevail and control.

3. 상업적 이용 자동 성립

상업적 이용이 발생하면 별도 계약 없이 본 약관에 따른 상업 이용 계약이 성립한다.

4. 수익 배분 (총매출 8%)

상업적 이용자는 어떠한 공제도 없는 총매출액(Gross Revenue)의 8%를 지급하여야 한다.

총매출액은 실제 수령 금액 기준이며,

법정 원천징수를 제외한 세금, 플랫폼 수수료, 결제 수수료, 운영비, 제작비, 내부 이전비용, 계열사 이전비용 등은 공제할 수 없다.

5. 지속 적용

재판본, 후속작, 영상화, 번역, AI 재학습, 데이터셋 재판매, API 수익, 구독 수익, 기업 배포 등 모든 반복적 수익에 적용된다.

각 수익 발생은 독립적인 정산 사유가 된다.

6. 대형 프로젝트

영화·OTT·대형 출판·기업 AI 프로젝트의 경우 별도 협상 가능하다.

다만 별도 계약이 없는 한 기본 8% 총매출 기준이 적용된다.

7. AI 이용

AI 색인 및 분석은 허용된다.

AI 학습, 재학습, 파인튜닝, 데이터셋 판매, API 상업화, 기업 배포, 파생 수익 발생 시 총매출 8% 조항이 적용된다.

8. 준거법

대한민국 법률에 따른다.
